On the Role of Preambles in International Law, EU Law and Internal Law

Summary/Abstract: In the paper the author makes an attempt to present the different roles that preambles play in the various legal systems that currently are in force in Bulgaria, in particular International Law, EU Law and Internal Law. On the basis of various examples from many bilateral and multilateral treaties, primary and secondary EU legislation and internal Bulgarian legislation it is demonstrated that although preambles play different role nowadays they have reserved place in the various legal systems under consideration. Several proposals de lege ferenda are made in the article mainly with regard to the proper terminology to be respected when texts of preambles are referred to in academic writing, legislation or everyday legal practice.
