Summary/Abstract: Political parties are the permanent organizations aiming at acquiring political power through elections or at least to become partner in it. Today, one of the essential conditions for a country to be taken part in the category of democratic regimes, as a requirement of pluralism, is the existence of more than one political parties in that country. In this context, political parties are one of the indispensable elements of democratic regimes, but another important point that completes this element is to be able to fulfill their activities freely. However, it is also seen there are some legal regulations and practices in many countries regarding the closure of political parties. This study examines the legal status of political parties and its regime of closure and shows how political parties can be organized and in which cases they can be closed in domestic law in the Fifth Republic in France, which is in the category of democratic regimes and one of the leading examples of European democracy. It is also determined how France’s approach to the closure of political parties compatible with the understanding and the principles laid down in the Venice Commission’s reports.
