Practical problems regarding the exercise of the prefect’s administrative tutelage right

Summary/Abstract: The article aims to identify some of the problems that the prefect's control over the acts of the local public administration authorities has raised for the administration, over time, but especially for the administrative contentious court. The analysis starts from the legislation in this field, from the point of view of the contradictions that characterize it, from the point of view of their reflection in the administrative courts jurisprudence, but also with regard to some significant aspects raised by the doctrine. The analyze is an exclusively legal one, being expressed in the doctrine points of view on the political character of the exercise of the administrative guardianship, beyond the professionalization and depoliticization of the perfect's function, formally proclaimed by law.
