Legal and practical aspects of determining the development conditions for agricultural land located in protected landscape areas

Summary/Abstract: Public space is the common good. However, it is subject to the management and development at the level of central and local government. Public administrations planning to use the available land must take into account the interests of stakeholders, targets resulting from the public interest and the requirements set out in separate legislation. Areas belonging to the jurisdiction of public institutions are allocated for construction residential, commercial buildings or green areas. In determining land use authorities may introduce a number of restrictions that modify the use of the powers conferred on property owners. Prohibitions result not only from the very essence of development plans, but also special laws. For example, you can specify the regulations of the Environmental Protection Act, which regulate functioning of protected landscape areas. These areas characterized by specific, values are natural land with significant market price. Restrictions imposed by local law with established protected landscape area often do not correlate with the possibilities of disposal of the property for specific investments. This publication is to present the issue of the establishment of conditions for development of agricultural property, located in the area of protected landscape. The author would like to present some problems legal and practical arrangements regarding the above procedure including proposals de lege ferenda.
