Summary/Abstract: The article reviews the question of the arbitrability of disputes on business frustration of privatization contracts in the light of a decision under Art.47 of ICAA rendered by the Supreme Court of Cassation. The critical analysis concludes that the prohibition on the renegotiation of privatization contracts established in the imperative provision of Art. 32, para. 5 of the PPCA does not lead either to the inference of non-arbitrability of business frustration disputes or to the conclusion that they are a priori without merits.
