Summary/Abstract: Ultimately, the legislation on drugs has undergone a long series of alterations and additions up to current form materialized in Law no. 143/2000 and the new Criminal Code. In its current form, the legislation regards the situations that may arise in practice is very comprehensive. Through this study, we address certain gaps inherent in the case of changing legislation that face continually with new situations brought about by Romania’s transformation from a transit country into a drug-consuming country. In this order, it is noted the change in vision that the legislator had with the changes brought to the law 143/2000 by the law no. 522/2004 in what concerns the drug users. Note so that these people are seen increasingly more as victims and not as criminals. The law begin to align, somewhat shy, the laws of other countries that don’t punish the drug consumption.
