Summary/Abstract: In this study, the authors analyze some important issues concerning offenses against state borders of Romania, regulated in Title III of the New Criminal Code with offenses against authority, focusing on preventing, detecting and investigating them. Romania is membership of the E uropean Union and it intercedes for the Schengen area, and for this reason it is essential that the country's borders to be safety, to be secured to the highest standards, and for this it imposes first to adapt continuously the national legislation with the European one. Legal regulations must be completed or modified continuously to suit the needs and requirements of modern society, so that citizens be in constant safety.
