Summary/Abstract: Failure to conduct a preliminary chamber procedure is sanctioned with absolute nullity; this, although not explicitly provided by law, has a virtual character and the rank of a procedural principle, resulting from the interpretation of basic procedural rules and constitutional principles. Another interpretation would allow any other phase of the criminal proceedings to be eluded on the grounds that the text governing absolute nullity does not expressly provide for this situation.
