Role of a Professional Legal Guardian and the Workplace in the Enforcement of the Penalty of Restriction of Liberty

Summary/Abstract: The article describes the rights and duties of the professional legal guardian and the workplace (other entity), in which the penalty of restriction of liberty is exercised, in regard to the enforcement of this penalty. The scope of these rights and duties my vary depending on the kind of the punishment – an obligation to perform not paid, controlled work for social purposes or deductions from the remuneration for work. The Author draws attention to loopholes, inaccuracies and inconsistencies in the applicable regulations which may impede the correct execution of the penalty of restriction of liberty. The incompleteness of the regulation is particularly evident with regard to the deductions from the remuneration for work.
