Criminal Liability of Legal Entities in the Light of New Legal Regulations

Summary/Abstract: The liability of legal entity having its origins in Ancient Law, reappears at the end of XIX century in the attention of European penal judicial literature, so that today it represents one of the central subjects of both scientific and legislation measures. The penal liability of the legal entity resulted along the time, within the judicial doctrine, in veritable controversies. The penal liability of the legal entity is a recently consecrated institution within Romanian Penal Law. Within the contemporary national penal law, the penal liability of the legal entity was initially regulated by means of provisions of Law no. 278/2006 for changing and completing the Penal Code as well as for changing and completing other laws, and the new Penal Code of Romania, adopted by means of Law no. 286/2009, published in Official Gazette no. 510 dated 24th of July 2009, entering into force on 1st of February 2014, expressly regulated the penal liability of the legal entity by means of provisions of art. 135 – 151.
