Summary/Abstract: In the specialized literature the opinion that the parliamentarians are assimilated to the civil servants in the acceptance of the criminal law is attested and it is possible to employ their criminal responsibility for any crime that has as a qualified civil servant an active subject.The criminal activity of the parliamentarians presents some specificity generated by the special status held by the national elected officials but also by the complexity and diversity of the functions of the parliamentary function and, consequently, any analysis regarding the criminal responsibility of the parliamentarians must also relate to the particularities of the parliamentary activity.
