Summary/Abstract: The article is structured in two parts. The first part analyzes the main means of defending the rights of the invention, according to three categories of defenses such as: administrative means (appeal and dismissal), civil remedies and not least the means of criminal law and in the second, as was natural procedural aspects are settling claims arising from rights covering inventions.
