Summary/Abstract: This article analyzes the jurisdiction of the Orthodox Churches from the point of view of the Catholic Church. The Churches of the East have the power to govern the disciplines proper to them (UR 16), so they have the regular and proper jurisdiction. This jurisdiction concerns then also the matrimony, if it is not contrary to the right faith and the divine law. The right to govern the disciplines proper to them is conceded to the Orthodox Churches also by the valid eastern canon law (CCEO can. 780), with the limitations contained in the declaration of the Supreme Tribunal of the Apostolic Signatura from the October 20th, 2006, regarding the single status of divorced orthodox Christians who whish to celebrate the matrimony with a Catholic. The Catholic Church thus concedes the jurisdiction of the Orthodox Churches concerning the celebration of matrimony, not however by its dissolution (except of nullity), because the Orthodox use prefers the divorce to the declaration of the nullity.
