Summary/Abstract: The text aims to proof hypotheses on withdraw of Polish state from activity in environmental protection and communal services. It is divided into two main parts. The first one describes activity of the state regarding functions of environmental protection. The second one focuses on communal services delivered by the local authorities, its role, instruments and specifics. Whole text bases on Polish literature of administrative law, environmental law and communal law, public statistics data and legal acts valid on June 15th of 2017.
