Summary/Abstract: The act of the defendant to carry out construction works at the building-apartment located in the Municipality of Cluj-Napoca, the protection area of the “Historical Centre of Cluj City” of the "Historical Center of Cluj” complex, meets the constitutive elements of the offense set out in art. 24 a) combined with art. 3 par. (1) b) of the Law no. 50/1991 on the authorization for performing construction works, republished, with subsequent amendments. The conditions set out in art. 83 of the new Criminal Code are met in the case, so it is necessary to stay the enforcement of the penalty of 4 month imprisonment delivered against the defendant.
