Summary/Abstract: The act of the defendant to perform construction works without building license on a building located in the protected area of a historical monument meets the constitutive elements of the offense set out in art. 24 a) combined with art. 3 par. (1) b) of Law no. 50/1991 on the authorization for performing construction works, republished, with subsequent amendments. However, the social values on discipline in constructions and protection of historical monuments suffered minimal damages, the works being necessary and urgent, which is why the act committed by the defendant does not pose the social danger of an offense.
