Summary/Abstract: The paper deals with the particularities of the liability of the insurer in two types of civil liability insurance: the motor vehicle insurance against civil liability for third-party damage caused through motor accidents and the insurance for medical malpractice. The different foundation of the two forms of liability, the quality of professional which has to be recognized to the medical staff, the social impact of the insurance for the damage caused to third parties by traffic accidents are as many criteria for differentiating the legal regime applicable to the two types of insurance, which end up marking the cases where the civil liability insurers can be exempted from liability.
