Considerations regarding the offense provided by art. 89 of GEO no. 195/2002 - leaving the accident site

Summary/Abstract: The offense of leaving the place of the accident provided by art. 89 of O. U. G. no. 195/2002 still arouses the doctrine’s attention due to the many interpretations of both the courts and the criminal authors on the essential requirements set out in its constitutive content. In 2008 the Romanian General Prosecutor filed an appeal on points of law to ensure uniform practices regarding the proper legal classification of the offense. The Romanian Supreme Court sliced upon the meaning of the expression 'bodily or health injury" but there are other problems of interpretation, including the circumscription of premise situation of this crime.
