Summary/Abstract: The subject of our paper reffers to the theory according to which the building contractor, the arhitect or other particpants in the making of a building are not held liable if the client decides to accept the risks that might appear during the edification of a construction and that, at some point, might cause dammages to the client or to other people. Throughout this study we will present the effects of this theory and the requirements that have to be fullfilled in order for this theory to find it’s application.
