CRIMINAL-LEGAL ASPECT OF THE CRIMINAL OFFENSES OF HARASSMENT

Summary/Abstract: The author deals with the question of introducing a new criminal offense of "stalking" in the criminal legislation of the Republic of Serbia. Namely, Serbia in 2013, ratified the Council of Europe Convention on preventing and combating violence against women and domestic violence, which requires that the persecution prescribed as a criminal offense. Given that this is a behavior that permanently disrupts the lifestyle of the victims, it is necessary to contribute toward initiation of the study of victimization and persecution, legal and social reforms in our country. Stalking is increasingly identified as a specific and complex problem, which in the last two decades, recognized and actualized in the world in professional, scientific circles and in the media and in everyday speech. The main aim of the definition of the concept and characteristics of persecution, pointing out the basic modalities of the act, looking back on the measures to be taken in the world to prevent this phenomenon, as well as the punishment of perpetrators.
