Summary/Abstract: The essence of criminal law is the precise and predictable nature of incrimination rules. Such a requirement responds to the need for individual legal certainty, and it is essential that, before judging a behavior, there is a guarantee that the legal provisions have been made available in unequivocal language and that the text is easily understood by the addressees. This study seeks to apply these requirements to the issue of survival of the term ”commercial” in criminal law after the entry into force of the civil code, which has cleared off the distinction between civil and commercial. The effectiveness of applying certain rules of incrimination depends on the way this issue is dealt with.
