Prospects of Utilization of a Private Foundation by Family Businesses in Poland

Summary/Abstract: An accumulation of recent data suggests that the Polish economic landscape has started to shift towards family businesses whose rising importance as key contributors totheir communities is undeniable. Accordingly, it is justified to consider what present and future needs of family businesses are. The objective of this article is to demonstrate that the existing economic and legal environment in Poland does not secure any effective legal structure that would at the same time facilitate management of a family business’s assets efficiently and guarantee their multigenerational protection. In light of the above, it would be reasonable to take into consideration adopting into the Polish legal system a family foundation which might meet the needs of a family business community.
