Summary/Abstract: The applicant for a permission to register a drawing or pattern enjoys priority which may be conventional or exhibition-related. Thus, according to the provisions of Art. 16 para. (1) Law no. 129/1992 on the protection of drawings and patterns, individuals or legal entities of the states which are part of the conventions Romania adhered to shall benefit from a 6-months right of priority, starting with the date of making the first submission, if applying for protection within this deadline, for the same drawing or pattern. The priority date is defined as the date of first submission of the application to register the drawing or pattern, regardless of the competent national authority with which the application is submitted or the date of displaying the drawing or pattern in an international exhibition, in the conditions stipulated in the Paris Convention for the protection of industrial property of 1883.
