The Termination of Life on Request: An Analysis of the Concept’s Evolution

Summary/Abstract: The controversial issue of euthanasia, settled by the legislator of the New Criminal Code within the provisions of the Article 190 is linked to the issue of the criminalization of homicide and especially the position of the passive subject of the offense. In this study, we intend to analyze the main guidelines of the termination of life on the victim’s request, starting from the principle that the right to life is enshrined among the essential rights of the human being in the Universal Declaration of Human Rights, a statement taken up in a lot of Constitutions of different countries (Article 22 paragraph 1of the Constitution of Romania). The right to life is the most important human right, occupying the first place in the hierarchy of social values, is protected as such by our legal-criminal system. An important role is played by the criminal law as a mechanism of control and, at the same time, of punishing those who carry out harmful activities that harm or endanger life. This does not mean a limitation of scientific research in the service of man.
