Summary/Abstract: This article discusses the problems of the control of the emperor over the construction, maintenance and destruction of buildings, which are related to the neccessity of preservation of public and private buildings and the aesthetic aspect of the cities. In the article are analyzed some literary and legal sources, mainly imperial constitutions from the Theodosius` and Justinian`s Code, which introduce certain restrictions for the owners regarding the destruction of their houses and the extraction of building elements and materials from there. The Novella IV de aedificiis publicis from 458 AD of the Emperor Majorian is examined in details, assuming that the legal norms that show the beauty and the urban greatness of Rome and other cities are because not only of the aesthetic reasons but also because of the aspiration to regain the glorious past and an unsuccessful attempt to eliminate the forces that inevitably lead to the destruction or transformation of the whole West.
