Summary/Abstract: The process of unification of European countries, started in Paris in 1951 by the treaty establishing the European Coal and Steel Community, has been lasting for already 59 years. It is a creative „constructive“ effort to find an alternative solution on the European continent for the existing model of rule based on nation, religion and state sovereignty established already in the 18th century. The process of European integration is conditioned by two, at first glance irreconcilable needs and aspirations. In order to respond to contemporary economic and political challenges, the Union country members are forced to move toward increasingly higher transfer of their competences to the European Union and to build efficient institutional and legal system of the Union with federal characteristics. On the other hand, the Union members in the same time attempt to preserve their national identities and sovereignty. Institutional solutions which should realize the motto from the proposed EU Constitution of 2004 reading „united in diversity“ are not given in advance nor can be found on other continents. Due to historical and cultural specificities of Europe, they were and shall be deriving from creative efforts of several generations.
