Summary/Abstract: Without a doubt election law is one of the main political rights written down in the Constitution. Exercising this right, however, is realized in an administrative way. This is why it is necessary that a governmental administrative unit that solely monitors and organizes the entire election process is established and this unit should be as independent as possible from the executive power. It can be considered that the foundation of this administrative structure has been set with the admission of the second Electoral Code in 2014, however at this point the process has not been completed. This is why the present article frames the basic problems that the election commissions, created ad hoc, face and it is expected those problems to be resolved by the legal instruments of legislative power. An option has been presented for the comprehensive construction of administrative organs – determining their status and the legal acts they issue, in regard of their proper functioning and the exertion of control over the election process and the following appeal procedures of the election results overseen by those organs. The primary focus is based on the need of well-educated administrative staff which is a prerequisite for legal certainty and transparency in the entire election process and the accuracy of the election results.
