Determination of Age Qualification of Employment and Justification Thereof

Summary/Abstract: Application of the principle of equality is of global importance. The article deals with the problems of discrimination on the ground of age of employment. The article deals with determination of both minimum and maximum age qualification of employment within legal acts of Lithuania and the legitimacy of possibilities to work being of certain age. Attention is drawn to the fact that upon the analysis of legal acts it was established that the legal acts of Lithuania providing both minimum and maximum age of employment did not infringe the requirements of the Directive relating exceptions; however, in the opinion of the author, the limit of the maximum age of employment is not sufficiently grounded. As well it was noticed, that persons of maximum age of employment are allowed to work in case an appropriate authorization is received from certain body. The ungrounded restrictions on age may be held discriminating.
