BOSNIA AND HERZEGOVINA AS DEMOCRATIC AND THE STATE BASED ON THE RULE OF LAW RESPECTING HUMAN RIGHTS AND FREEDOMS

Summary/Abstract: The modern democratic and the State based on the Rule of Law which respects the Human Rights and Freedoms is very important for development of economy, society’s institutions and all other progress. However, such State is very important for multinational as well multi-religious community. According to the Annex 4 of the General Framework Agreement for Peace in Bosnia and Herzegovina, the State Bosnia and Herzegovina is democratic and the State based on the Rule of Law with free and democratic election. In this sense, the State Bosnia and Herzegovina has obliged to secure the highest level of internationally recognized human rights and fundamental freedoms. So, according to the Article 2.2 of the Constitution of Bosnia and Herzegovina the European Convention on Human Rights became the special status. This article stated that the ‘rights and freedoms set forth in the European Convention for the Protection of Human Rights and Fundamental Freedoms and its Protocols shall apply directly and shall have priority over all other law’, including the constitutional law. The State Bosnia and Herzegovina, as all other modern and states based on the rule of law, signed all other international and regional instrument for the protection of human rights. Insisting to respect human rights and fundamental freedoms, as in all other democratic and the states based on the rule of law, all people should be brought in the equal position before the law, in order to overcome antagonism on ground of religious, ethnical, racial and national differences of the society of Bosnia and Herzegovina.
