Summary/Abstract: The subject of this paper is the Constitutio Act adopted in 320 AD by Emperor Constantine the Great, which abolished the sanctions imposed on bachelors (caelibes) and the childless (orbi). Those sanctions were first introduced by Augustus's matrimonial legislature (Lex Iulia et Papia) in 18 BC and in 9 AD. The aim of this paper is to draw the attention of general scientific public, particularly in Nish (as Emperor Constantine was born in the ancient town of Naissus), to this very important act which is distinct by its prevailing spirit of tolerance, which was also an outstanding feature of the Milan .
