Summary/Abstract: The essential elements of a contract in the continental system of law are: the capacity to conclude a contract, the consent, the consideration and the object. As we will see, following the present analyse, there are important differences between these elements in what concerns the two different law systems that exist in the European Union: the continental system of law and the common-law system. This analyze aims to focus on the consent as an essential element of the contract and approaches the main similitudes and the most important differences between the abovementioned systems.
