Summary/Abstract: The emergency ordinances institution appears in the Romanian legal system as a specific way of exercising the legislative power by an organ of executive power, the Government. The legal framework of this institution is emerging through the current rules of constitutional or legal order, and with reference to the case law review of the Romanian Constitutional Court, and cover issues related to the causes and strict conditions to be met for the exercise of such competence, the procedure to be followed for this type of legislation to have legal effects and the limits imposed to the regulatory power by emergency ordinance.
