LINGUISTIC AND LEGAL IMPLICATIONS OF THE UNION OF TRANSYLVANIA AND ROMANIA: NEW LATIN WORDS IN THE WORKS OF THE TRANSYLVANIAN JURISTS GEORGIU PLOPU AND ŞTEFAN LADAY

Summary/Abstract: After the union of all Romanian provinces, an essential condition for the existence of Romania as a unitary state became the concretization of the legislative unification, which involved the same laws to be applied across the country. Unlike Bessarabia and Bukovina, this process was extremely laborious in the case of Transylvania, where, until 1943, the Hungarian and Austrian civil legislation remained in force and was unknown to the jurists from the Old Romanian Kingdom. The need for the elaboration in Romanian of several works that would enable all Romanian jurists to know the legal system which applied in Transylvania became stringent. The most important contribution in this direction belongs to the Romanian jurist scholars Georgiu Plopu – author of a monumental work, “Părţi alese din dreptul privat ungar” (2358 p.), considered to be “the first treatise of Hungarian private law in Romanian and Hungarian legal literature” – and Ştefan Laday – author of an extremely useful work for practitioners, “Codul civil austriac în vigoare în Ardeal completat cu legile şi regulamentele modificatoare, cuprinzând şi jurisprudenţa” (2039 p.), considered to be “the most important work of civil law in Romanian doctrine for those situations in which local legal norms apply in Transylvania”. As a result of a research on the two above mentioned authors, I have identified over 300 specialised legal and general vocabulary terms which do not appear in any Romanian language dictionary. The present study focuses on 60 Latin words.
