EXERCISING THE RIGHT TO VALORIZATION OF CASH RETURNS

Summary/Abstract: The amount of certain cash annuity installments depends on a series of legally relevant facts. Rights to change the cash annuity amount, which is by its nature a convreting law, is executed in a case according to results of the general legal proceeding. Right to change the amount of the annuity arises when, owing to new circumstances, there are real changes of the damage scope. Researches indicate that the claim for change of the amount of cash annuity is not a cause when it is based only on the fact of purchasing power decrease. It is the author's suggestion that by appropriate law amendments the right to valorization of the cash annuity is to be recognized by any . means and that the special proceeding for the execution of the rihgt is to be foreseen and arranged as well.
