Summary/Abstract: The paper deals with the hypothetical settlement of marital property, new institute, arranged in § 732 of the Act no. 89/2012 Coll., The Civil Code, which according to the author deserves much more attention than it had previously dedicated. The aim of this paper is to answer the following questions - what is hypothetical settlement, when and under what conditions can be used, what are the procedural means of protection „against“ hypothetical settlement of marital property.
