The scope of application of care for a healthy child (art. 188 of the Labour Code of the Republic of Poland)

Summary/Abstract: The following paper aims at explaining the issues regarding the interpretation of application ofart. 188 of the labour code. This article should be interpreted pursuant to the principle of favouring an employee and in accordance with the teleological interpretation principles. It is to be notedthat axiologically the values protected are the family, the child and the community, ie the employerand the state. Thus, while the time off for caring a child may be granted on daily or hourly basis,the specificity of the employer allows the employer in specific situations to refuse to grant the employee the right to exercise the said entitlement on the hourly basis.
