Summary/Abstract: The civil-law distinction concerning the legal situation in terms of protection afforded to debtors in auction sales who are former tenants and other debtors who previously enjoyed the status of tenants is an instance of unjustified inequality before the law. The article aims to examine the legality of possible courses of action civil courts may take in order to fairly apply the law despite having established the existence of a loophole in this area.
