Expanding the applicability of provisions on the warranty of goods for sale to other contracts and not only to goods

Summary/Abstract: The article presents the characteristics of the guarantees resulting from the regulations of the Polish Civil Code, case law and selected literature. In particular, it examines the obligatory provisions concerning this institution in order to determine the scope for the application of the principle of contractual freedom. The identification of the limits of this scope allows, in turn, to determine the characteristics that must be indicated in the contracts in order to apply the guarantee to the subject of these contracts. The conclusions of the aforementioned findings make it possible to conclude that a guarantee does not have to be bound only to the contract of sale, and its subject does not have to be necessarily just an item.
