Summary/Abstract: This study deals with the extremely important issue of hearing a minor as a witness in criminal proceedings. The author explains the concept of a minor and defines the institution of the witness, especially with regard to the censorship of the age. The article presents the question of the independence of a minor witness in criminal proceedings, in particular the right to refuse to testify. The issue of properly instructing a minor witness about his or her rights and obligations is also dealt with. The author then discussed the issue of re-hearing a minor victim under art. 185a § 1 k.p.k. and proposed its own solution to the discussed matter. In conclusion, the author draws conclusions from the discussion and presents the postulate de lege ferenda.
