Summary/Abstract: In penal law, safeguards appeared in the late nineteenth century as a result of the search for new, more effective methods of combating crime. They were based on the assumption that the application of a prohibited act to a perpetrator should not be decided by fault and its social danger, which was to be determined by the lifestyle or behawior.
