Summary/Abstract: The present article gives a profound analysis of the problem of divorce in Muslim tradition. The religion very categorically emphasises that the good of a family and the children brought up there is most important therefore, every pathology ought to be managed and solved. Undoubtedly, a divorce is a painful experience for all the family members, however, when there is no possibility to improve the mutual relations – the situation should be averted by managing a divorce. Islam is perceived as a patriarchal system in which every field of social life is dependant upon the decision of a man. Yet, the issue of dissolving a marriage is not dependant on him only. According to the Muslim law, a woman may also file a petition with the court. Regardless of the petitioner’s sex, there must be grave premises to manage a divorce.
