Summary/Abstract: This paper aims to outline the vision of the new Civil Code concerning injury prerequisite of torts, trying to highlight the main trends innovative legislator in this matter, such as enshrining the right of victims to compensation for damage caused by injury; to interest injury; loss of the opportunity to gain an advantage or to avoid damage; bodily injury; injury by ricochet; to moral damages. Also, by way of novelty, it is dedicated obligation moderation creditor injury.
