Summary/Abstract: The article focuses on the actual and future legislation regulating informatics search, including the conditions of the judicial warrant for this criminal procedure. The actual Law nº 161/2003 and the project of the future Criminal Procedure Code are critically analyzed in order to underline their possible violations of the fundamental right to private life protected both by the Constitution and by the European Convention of Human Rights.
