Summary/Abstract: Industrial property law has as object patents, utility models, deisgns, trademarks, commercial names, indication of sources and appellation of origin. Romanian legislation uses the notion of geographical indication. An appellation of origin presents the same caractheristics as a geographical indication. The conflict between trademarks and geographical indications appears when a geographical name is registered as trademark and geographical indication. Jurisprudence gives different solutions in accordance with the real elements of the case. în general, the conflict is solved according to priority right.
