Summary/Abstract: The economic analysis of criminal justice law implies the application of basic principles of efficiency in creating an optimal level of general prevention. The use of economic instruments tends to anticipate the effects of criminal sanctions on the behaviour of potential perpetrators. The use of economic instruments for assessing the behaviour of a potential perpetrator has led to economic crime models. The paper presents an overview of basic economic models of crime in a way to underline their conflicting points with key criminal law institutes in material and process terms.
