Summary/Abstract: The article focuses on Open Data form and the electronic means providing access to the information of Czech and EU public institutions. Both legislations are derived from similar ideas of state of law and documents of Council of Europe. Even though we can see apparent differences either in legislation itself (mainly in Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents and Czech The Act No.106/1999 Coll. on Free Access to Information) either in application of these legislative acts. Comparison of the both legal acts and legal practise thus brings inspiration and useful hints de lege ferenda.
