Summary/Abstract: The action of the prosecutor who, during a telephone conversation with the wife of an accused, makes denigrating statements regarding the activity carried out by his fellow prosecutors, as well as regarding a witness heard in that case, meets the constituent elements of the disciplinary deviation provided by art. 99 let. a) of Law no. 303/2004 regarding the statute of judges and prosecutors republished, with subsequent amendments and completions. The action of the prosecutor who, during a telephone conversation with the wife of an accused, gives guidance regarding the defenses and the requests to be formulated in a case being investigated, meets the constituent elements of the disciplinary deviation provided by art. 99 let. b) of Law no. 303/2004 regarding the statute of judges and prosecutors republished, with the subsequent amendments and completions.
