Internal Legal Consequences of EU External Agreements

Summary/Abstract: This paper aids at analyzing legal consequences that so-called EU external agreements may have in internal legal orders of EU Member States. These consequences are linked first of all to the double nature of the said external agreements as – at the same time – EU law acts adopted by EU institutions and treaties under international law. A second layer of consequences arises from domestic rules linked to approving these external agreements by internal constitutional procedures; this area is specifically sensitive with regard to EU CFSP agreements. Thirdly, international and EU responsibility of both EU and its Members States for carrying out external agreements is analyzed. These problems are particularly integrating because international law rules of international organizations’ responsibility are only being formulated.
