Summary/Abstract: The Law on handling complaints by financial market entities and on the Financial Ombudsman adopted in August 2015 became a significant legal instrument for policyholders, insured and injured in their disputes with insurers. Starting from October 1st, 2018 when act on insurance distribution enters into force, complaints procedures will encompass also insurance intermediaries (agents and brokers). Access to those procedures – on the basis of article 16 of the distribution act – shall be open in insur- ance market to legal entities and some unincorporated entities with legal capacity. Similar as it was 3 years ago, said provisions are a source of certain doubts e.g. in scope of their practical appliance. Due to all these facts, there is a need for an analysis of the new solutions in question.
