LEASING TRADES IN ROMAN LEGAL SOURCES

Summary/Abstract: The article analyzes Roman legal sources in which we can, in principle, establish certain parallels and similarities, and therefore examples of a leasing contract for commercial finance, which has been gaining importance since the middle of the last century. In particular, we focus on the so-called operational leasing, given that in the Roman texts at issue the object of leasing is a productive asset – gladiators, horses, real estate, etc. When seeking a parallelism between the legal transaction according to Roman sources and the leasing contract in force, we can present a number of practical problems and the ways to resolve them by Roman and contemporary lawyers.
